Out-of-state visitor causes fatal accident in South Philadelphia

Earlier this month, a 25-year-old Philadelphia resident was killed when his car was hit by a suspected drunk driver. Though it is unclear whether the family members of this 25-year-old will file a wrongful death lawsuit following their loved one's death, these are the kinds of accidents that generally lead to wrongful death or personal injury claims.

First of all, the driver is suspected of drinking and driving. As a 20-year-old, it is illegal for him to be drinking, and a judge or jury can probably be convinced that him drinking while driving makes him negligent. Add to that police officers' reports that the driver displayed signs of intoxication and that he lost control of his vehicle, and the young man could be held liable for the other driver's death.

The accident happened in South Philadelphia in the southbound lanes of Interstate 95. The younger driver apparently lost control of his Nissan Armada, which then smashed into the back of the older driver's Volkswagen Jetta. The impact sent the Jetta into the right concrete barrier, causing the driver's fatal injuries. Even though police and paramedics responded to the crash, the 25-year-old died at the crash site.

Not only was this driver killed, but the suspected drunk driver's passenger was also injured in the crash. He was sent to the hospital in critical condition and it is not entirely clear if he will make it. Should he die, his family members may also be able to file a wrongful death lawsuit for their loved one's death. As it is, the passenger may be able to file a personal injury lawsuit if he eventually recovers.
