Fathers' rights to parent their children

It is unfortunate that some Pennsylvania fathers who have gone through a divorce find themselves in situations in which their former spouses control when and even if they can see their children. Some fathers mistakenly believe there is little they can do when the mothers prevent them from exercising their custodial and visitation rights.

Fathers have just as many rights as mothers do to parent their children. Some mothers try to control how fathers can see their children, forcing them into positions in which they have to ask permission. Even though the judicial system has made strides with recognizing the rights of fathers, courts often still show bias in favor of mothers.

In some cases, courts will order that both parents have equal access to children's medical appointments and educational information. Some mothers who schedule appointments do so without informing the fathers. When fathers do attend appointments at school, they are sometimes treated as secondary or as if their opinions do not matter. Judges sometimes also only give fathers the minimum amount of parenting time with their children, relegating them to statuses of being part-time parents.

Fathers who want to seek parental rights to their children are able to file petitions for child custody and visitation. When orders are issued but the mother interferes with visitation, for example, the father may file a motion requesting that the mother be held in contempt. Legal counsel can often help clients to get joint physical and legal custody so that they can develop and maintain the quality relationships that their children deserve.
