How to Divide Car Insurance After Divorce

August 28, 2017

When Pennsylvania couples get a divorce, there are many aspects of property division that must be addressed. One of those that may not always be thought about is splitting up car insurance.

The two people will probably need to have separate addresses in order to get separate policies. Before either person is removed from the existing policy, a new policy should be set up first. Vehicle titles should be separated, and it will be necessary for one person to get a new policy.

A person cannot be removed from an insurance policy without consenting. In most cases, the couple should wait until the divorce is nearly final to go through this process. One reason to do this is in case the couple decides to stay together.

Car insurance is only one small part of the division that will need to occur in many divorces. One of the first things a person might want to do is take a look at the family assets and liabilities. The couple may need to divide debts as well as shared marital property. The couple may want to negotiate the division of property with the assistance of their attorneys, or they may go through litigation. The former may give them more control over the process, but it does require that both people are willing to participate and cooperate. Divorce is often an emotional time, and a person who feels guilty about ending the marriage or wants the process over with quickly might agree to an unfavorable financial settlement.
