Will mediation be better for you than divorce?

Even though we see and hear of marriages ending with fights, court battles and divorces that ruin any chance of former spouses ever getting along again, there are other ways to end a marriage. While mediation and collaborative law are not right for every couple, when they are appropriate, they can often lead to better divorce settlements, a more cordial post-divorce relationship with an ex. Talking with a divorce attorney may be one of the best ways to determine if mediation would work well.

One of the reasons why someone in Doylestown may wish to divorce via mediation instead of in court is because if a divorce appears before a Pennsylvania court judge, an individual risks having a judge make arbitrary decisions about who should get what. Whether it is property division, child custody or child support, few people want to be told what they will get without having much input into the decision.

There is also a risk of noncompliance when it comes to divorce settlements. Even if a judge issues a fair settlement, one spouse may refuse to follow the orders. Though there are ways to enforce a divorce settlement, it may be easier to have both spouses work out a settlement with the help of a mediator. Having a greater role in creating a settlement will likely lead to a greater degree of compliance with the settlement.

Ultimately, it can be very difficult to divorce, but if there is a chance to have a more respectful, more cordial divorce process, why not go for it?
