Class action lawsuits for victims injured by defective products

Many different types of defective products are responsible for thousands of injuries in Pennsylvania and other states. Examples of these products include faulty medical devices, malfunctioning auto parts and defective drugs, to name just a few.

Manufacturers of defective products as a whole as well as makers of the parts that go into a product have a legal duty to protect consumers from harm. When they fail in this duty, injured victims often consider some form of legal action to seek justice.

Sometimes, victims of defective products pursue individual product liability claims as a remedy. Other times, joining a class action lawsuit--also known as mass tort litigation--is the best way for injured victims to find an effective solution. A class action suit is one in which individuals with similar injuries join together in a single claim against the manufacturer of a faulty or dangerous product.

Without knowing the details of any particular case, we cannot recommend one legal remedy over another. This is because each situation is unique and worthy of a thorough legal consultation before victims make any decisions. However, we do want our neighbors suffering from product injuries to know the advantages of a class action claim.

For example, in some cases, it is challenging for individuals to pursue a product liability claim alone. Banding together in a class action suit sometimes improves the chance of achieving a successful outcome. Another benefit of a mass tort is that upon success, all injured victims will receive some amount of compensation, even if the plaintiff is bankrupt or otherwise unable to pay individual claims.

We know that these matters are complicated and confusing for those unfamiliar with the legal industry. As such, we urge victims to seek a legal opinion to help them identify the best remedy. Please continue reviewing our website for additional information about product liability.
