It is difficult to define a catastrophic personal injury

Even if you spend all of your free time searching the Internet, you are unlikely to find an adequate definition for the term "catastrophic personal injury." Many courts and insurance companies define the term loosely as an injury that leaves the victim unable to engage in gainful employment on a permanent basis.

If you are suffering from a severe personal injury, you probably find the loose definition above completely inadequate. Well, it may be hard to believe, but we agree with you. We will even go one step further and argue that any personal injury can be catastrophic if it impacts your life significantly.

For example, say a distracted driver strikes you resulting in two broken legs. The consequences of these injuries will trickle down to all areas of your life. You will likely require hospitalization in addition to regular doctor visits. You probably won't be able to work or drive a vehicle for awhile. Going back to the definition we provided above, the injuries described in our example are probably only temporary instead of permanent. Does that make the situation any less catastrophic for you, our hypothetical victim? It does not! Your immediate and near-future situation is catastrophic to you and your family.

While you and we view your circumstances as life-changing and dire, insurance companies and personal injury courts may not share this opinion. While you might be able to claim that your injury is technically catastrophic, we can argue that your situation is catastrophic financially.
